Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pinvine platform operated by Pavlovic Media ("Pinvine," "we," "us," or "our"), located at www.pinvine.com. By accessing or using Pinvine, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Eligibility

You must be at least 13 years old to use Pinvine. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using Pinvine on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To access most features of Pinvine, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Pinvine offers paid subscription plans. By subscribing, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select
• All payments are processed through our third-party payment provider (Polar). Your payment information is handled directly by Polar and is not stored on our servers
• Prices are listed in US Dollars (USD) and are exclusive of applicable taxes
• We reserve the right to change pricing with 30 days' prior notice

4. Cancellation and Refunds

• You may cancel your subscription at any time through your account settings or the customer portal
• Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then
• We do not provide prorated refunds for unused time within a billing period
• If you believe you have been charged in error, contact us within 14 days at info@pinvine.com

5. Acceptable Use

You agree not to:

• Use Pinvine for any unlawful purpose or in violation of any applicable law
• Violate Pinterest's Terms of Service or Community Guidelines through your use of Pinvine
• Upload or distribute content that is illegal, defamatory, obscene, or infringes on the rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated scripts, bots, or scrapers to access Pinvine (beyond the intended functionality)
• Resell, sublicense, or redistribute access to Pinvine without our written consent
• Interfere with or disrupt the integrity or performance of the platform

6. Intellectual Property

All content, features, and functionality of Pinvine (including but not limited to text, graphics, logos, software, and design) are the property of Pavlovic Media and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without prior written consent.

You retain ownership of any content you create or upload through Pinvine. By using our platform, you grant us a limited, non-exclusive license to process and display your content solely for the purpose of providing the service.

7. AI-Generated Content

Pinvine offers AI-powered features for generating pin descriptions, images, and other content. You acknowledge that:

• AI-generated content may not always be accurate, original, or appropriate
• You are responsible for reviewing and editing AI-generated content before publishing
• We do not guarantee that AI-generated content is free from intellectual property claims
• Usage of AI features is subject to the token limits of your subscription plan

8. Third-Party Services

Pinvine integrates with third-party services including Pinterest, Google, and Polar. Your use of these integrations is subject to the respective third parties' terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

9. Service Availability

We strive to provide a reliable service but do not guarantee uninterrupted or error-free access. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Pavlovic Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of Pinvine.

Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

Pinvine is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will meet your specific requirements or deliver specific results regarding your Pinterest performance.

12. Indemnification

You agree to indemnify and hold harmless Pavlovic Media, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Basel-Landschaft, Switzerland.

For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. If changes are significant, we will notify you via email. Your continued use of Pinvine after changes constitutes acceptance of the updated Terms.

15. Termination

We may terminate or suspend your account and access to Pinvine immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall survive.
